I. Definitions

Unless otherwise specified, the following terms shall have the meanings set forth below:

1.1 EasyRef AI Image Generation Service: Refers to the image generation function provided by EasyRef through its platform, which generates images based on user-input information. It may also be referred to as the "AI Image Generation Service," "AI Image Generation," or "the Service."

1.2 Images Generated by the EasyRef AI Image Generation Service: Refers to one or more images generated through the EasyRef AI Image Generation Service, hereinafter referred to as "Generated Images."

1.3 Users of the EasyRef AI Image Generation Service: Refers to users who browse, view, or use the EasyRef AI Image Generation Service and its Generated Images, hereinafter referred to as "you" or "users."

1.4 EasyRef Users: Refers to users who access and use the functions and services provided by the EasyRef platform.

1.5 EasyRef: Refers to the operating entity of the EasyRef platform and its affiliated operating entities, if any.

1.6 Third-party generative technology services: refers to generative artificial intelligence models and related technology services provided by third parties, including but not limited to Mini Banana Pro.

II. About the AI Image Generation Service

2.1 The AI Image Generation Service is developed by EasyRef based on third-party generation technology services to provide users with AI image generation functionality. The model algorithm mechanism used in this service is provided and maintained by the third-party service provider.

2.2 You can log in to the EasyRef platform and use the AI Image Generation Service via its functional entry points. You can input textual descriptions, keywords, or reference images to obtain AI-generated images. Generated images are limited to use scenarios explicitly permitted by EasyRef.

2.3 EasyRef reserves the right to determine the scope and conditions of users who can access the AI Image Generation Service.

2.4 EasyRef attaches great importance to the quality of AI-generated images and will make reasonable safety efforts to comply with applicable laws and regulations. If you find any issues or flaws in the outputs or processing results, you are welcome to provide feedback at any time.

III. Usage Tips

3.1 This service requires registration and login to an EasyRef account.

3.2 The service involves generative AI capabilities. Please use it rationally. Guardians should guide minors to prevent over-dependence or addiction.

3.3 Due to the current common industry technology level, we cannot guarantee that the Service is 100% accurate, reliable, error-free, uninterrupted, faultless, or consistent with the content theme; the accuracy, completeness, and timeliness of generated images cannot be guaranteed. You must judge the generated images yourself and assume any risk arising from the use of such content. We will make our best efforts to urge third-party generation technology service providers to provide stable and high-quality technical services.

3.4 Generated images are for reference only and do not represent EasyRef's views or positions.

3.5 EasyRef strives to maintain stable third-party service cooperation but cannot guarantee uninterrupted provision.

3.6 EasyRef may update the service and modify pricing or charging methods to improve user experience.

IV. Rights and Obligations of EasyRef

4.1 EasyRef will maintain the normal operation of this service to the best of current technical capabilities and strive to improve your user experience.

4.2 EasyRef reserves the right to block information or terminate services if you engage in illegal or inappropriate behavior when using the AI Image Generation Service.

4.4 If EasyRef receives a complaint regarding copyright infringement or other rights regarding generated images, it will request proof and take necessary actions such as deletion or blocking.

4.5 You agree that any disputes arising from your use of the service with third parties shall be your responsibility; EasyRef will not participate.

V. Rights and Obligations of Users

5.1 Your behavior should comply with the EasyRef User Service Agreement and platform rules.

5.2 You should use the AI Image Generation Service legally and not for unlawful or unethical purposes.

5.3 Generated images are created by third-party services. EasyRef does not guarantee their legality or non-infringement.

5.4 You understand that in extreme cases, generated images may still be claimed as infringing by rights holders.

5.5 You acknowledge and agree that upon receiving a notification from the image copyright holder (or pre-training image data rights holder) or an EasyRef user regarding a complaint about generated images, if after verification EasyRef determines that the generated images you used violate laws or infringe the legitimate rights of a third party, EasyRef will delete the suspected images or remove works containing the generated images and notify you of the results. Nevertheless, in extreme cases, your use of generated images may still be claimed as infringing by the image copyright holder and ultimately determined to be infringement. You should fully acknowledge and agree to this.

5.6 You must not use the service for fraudulent, misleading, or deceptive activities, including falsely claiming AI-generated images as non-AI.

VI. Intellectual Property of Generated Images

6.1 You shall ensure that any input content you provide, upload, or process during the use of this Service, and the rights such actions themselves involve, belong to you or that you have obtained legal authorization from the rights holder. You further guarantee that the aforementioned content does not involve any ownership disputes and does not infringe upon any person's legitimate rights (including but not limited to intellectual property rights, reputation rights, name rights, portrait rights, privacy rights, trade secrets, etc.); otherwise, any resulting disputes or risks shall be borne by you.

6.2 Unless otherwise agreed or restricted by third-party services or laws, you have intellectual property rights for generated images created through your creative input.

VII. AI Marks for Generated Images

7.1 We will, in accordance with laws and regulations, add corresponding AI-generated content labels to generated images, including explicit labels placed at appropriate positions on the generated images that can be clearly perceived by users (such as the text 'AI Image'), and implicit labels embedded in the generated image file data through technical measures that are not easily perceived by users (hereinafter collectively referred to as 'AI Labels'). You should carefully read and understand the relevant laws and regulations regarding the management of AI labels and shall not use this Service to produce, publish, or distribute false, untrue, infringing, or otherwise illegal content.

7.2 You must not remove, modify, forge, or hide AI marks. Violations may result in legal responsibility.

7.3 If you obtain generated images with removed explicit marks, you must still indicate that they are AI-generated when publishing or sharing.

VIII. Others

8.1 The content of these Terms constitutes a part of the 'EasyRef User Service Agreement', other agreements or rules in the attachments of these Terms, and any other related agreements or rules regarding the AI Image Generation Service that EasyRef may continuously release. Once officially published, the above content shall be an inseparable part of these Terms, and you shall also comply with it. In case of any conflict between the above content and these Terms, these Terms shall prevail. By registering or using any service under these Terms, you are deemed to have read and agreed to be bound by these Terms and the above content. EasyRef has the right to unilaterally modify these Terms or the above content when necessary. After the changes, if you continue to use the AI Image Generation Service, you are deemed to have accepted the modified content. If you do not accept the modified content, you should stop using the relevant functions.

8.2 The place of signing is Fengxian District, Shanghai, PRC.

8.3 These Terms shall be governed by the laws of mainland China (excluding conflict of law rules).

8.4 Any dispute shall first be settled by friendly negotiation; if unsuccessful, it shall be submitted to the competent court at the place of signing.

8.5 The titles of the clauses are for convenience only and have no legal effect. (End)
